Terms & Conditions – Destiny Yacht Pte Ltd
At Destiny Yacht Pte Ltd (“DYS”, “we”, “our”), we strive to provide our guests with a safe and memorable charter experience. These Terms & Conditions set out our policies on bookings, cancellations, rescheduling, safety, and other important matters. By booking with us, you acknowledge and agree to the following:
1. Cancellation by Guest
- More than 30 days before charter date – Full refund, less a $300 administration fee.
- 14–30 days before charter date – 50% refund of total charter fee.
- Less than 14 days before charter date – No refund.
- No-shows on the day of charter – Treated as last-minute cancellations, no refund.
- Cancellation of food & beverage services within 7 days of charter – No refund.
Rescheduling by Guest
- Requests must be made in writing at least 14 days before the charter date, subject to yacht and crew availability.
- Requests made 13 days or less before the charter date will be treated as cancellations (see Section 1).
- Weekend → Weekday reschedule (higher → lower value): No refund of price difference.
- Weekday → Weekend reschedule (lower → higher value): Guest must top up the price difference.
- Rescheduled bookings must be confirmed within 1 month of the original booking date, otherwise it will be treated as a new booking.
Late Arrival & No-Show Policy
- Guests are advised to arrive on time. The charter will commence and end at the scheduled times, with no extensions for late arrivals.
- If the Charterer arrives more than 1 hour late without prior notice, the booking will be treated as a no-show and no refund will be given.
- Confirmed guests who do not turn up will be deemed no-shows, and the charter will be considered fulfilled.
Cancellation by Destiny Yacht Pte Ltd
If DYS cancels a charter due to technical issues, unforeseen circumstances, or government restrictions, guests may choose between:
- Rescheduling without penalty, or
- Full refund of the charter fee.
- DYS is not liable for other costs (e.g. transport, accommodation, flights) incurred by the guest.
Refunds
- No refunds will be given for unused charter hours.
- Approved refunds will be processed within 14 business days via the original payment method.
Weather Policy
- Charters proceed in light rain or cloudy conditions if deemed safe by the Captain.
- Once the yacht has departed the marina, the charter is considered fulfilled and no refunds will be given.
- In the event of severe weather (as determined by the Captain or the Singapore Port Authority), the charter may be delayed, shortened, or rescheduled without penalty.
- Water activities will be suspended during unsafe weather conditions.
Safety & Conduct
- Guests must follow the Captain’s instructions at all times.
- DYS reserves the right to refuse boarding or terminate a charter for disorderly, unsafe, or illegal behavior. No refunds will be provided.
- No smoking indoors and no illegal substances are allowed onboard.
- Children must be supervised at all times by their parent/guardian.
- Shoes must be removed before boarding unless otherwise permitted by the crew.
Food, Drinks, Alcohol & Smoking Policy
- Guests may bring their own food and drinks unless catering is arranged with DYS.
- Alcohol may be consumed responsibly; service will be stopped if guests are intoxicated.
- Red wine, staining beverages, and durians are strictly prohibited onboard.
Insurance & Liability
- DYS carries standard marine insurance for the yacht and crew.
- Guests are responsible for arranging personal travel insurance to cover belongings, accidents, medical expenses, and cancellations.
- DYS shall not be liable for injury, loss, or damage to guests or property, except where caused by gross negligence.
Damage to the Yacht
- The Charterer will be held responsible for any damage, excessive cleaning, or expenses incurred due to their actions or those of their guests.
- Related costs may be charged directly to the Charterer. Receipts will be provided upon request.
- The Charterer may request to inspect damages and obtain an independent assessment before repairs commence, provided it meets insurer/owner requirements.
Indemnity
The Charterer agrees to indemnify and hold harmless DYS, its staff, and crew against any claims, damages, or expenses arising from the conduct of the Charterer or their guests.
Force Majeure
DYS shall not be held liable for failure to perform obligations due to events beyond its control (e.g. severe weather, government restrictions, pandemics, natural disasters).
Media & Marketing
- DYS reserves the right to use photos and videos taken during charters for promotional purposes (website, social media, marketing materials).
- Guests may opt out by informing DYS in writing prior to the charter.
- Guests may receive marketing updates; an unsubscribe option will always be provided.
Currency
All prices quoted are in Singapore Dollars (SGD) unless otherwise stated.
